Allahabad HC Safeguards 81 Apartments Owners From Demolition in Lucknow

                Lucknow: The Lucknow bench of Allahabad High Court has granted major relief to several flat owners of 81 apartments whose residents were slapped notice by LDA for vacating the 
apartments so that the said apartments could be demolished in pursuance to demolition orders issued to their builders about 19 to 20 years ago.
In-fact, on suggestion of LDA itself, the bench has permitted the flat owners to apply to the LDA for compounding their flats by depositing the requisite penalty.
The bench has , however, clarified that it would fix the accountability of the LDA officials who had failed to execute the demolition orders issued to builders 19 years ago.
The bench was of the view that for the fault of the builders, the flat owners, who had purchased the flats from their hard earned money and were not aware of notices to builders should 
not suffer.
A bench of Justice Rajan Roy and Justice OP Shukla passed the order on a writ petition filed by some flat owners of Royal Green Apartment situated in Mahanagar. The bench has 
stayed demolition of the apartment .
Earlier, LDA counsel Ratnesh Chandra informed the bench that LDA had proceeded to demolish the said apartments owing to an order passed by a co-ordinate bench in a 2012 PIL.
